The latest quarterly statistics issued by the Government indicate that in the quarter preceding the abolition of tribunal fees, there has been an increase in the number of complaints filed at Employment Tribunals.  In summary the statistics for the period October to December 2017 reveal the following trends:

  • There has been a 467% increase in claimants grouping together and presenting multiple claims.
  • Employees presented 8,173 single tribunal claims this quarter. This is a huge upward shift from previous trends of around 4,000 per quarter over the past 3 years and is most likely connected to the abolition of Employment Tribunal Fees.
  • In total the Employment Tribunals disposed of 7,775 claims during October to December 2017.
  • Early conciliation of complaints was achieved in 31% of cases with the assistance of ACAS.
  • The most common complaint presented by employees related to issues around unauthorised deductions.
  • Only 8% of the claims presented by employees were unsuccessful at hearing.

In view of the upward trend of claimants pursuing claims, employers should take care when dealing with employee relations issues. It’s always advisable to periodically carry out an audit of contracts of employment, policies and procedures to check that everything is up to date and compliant with legal obligations.
